Palmetto Machinery warrants to the original purchaser that the property listed in the sale contract invoice will conform to its description. If any mis-description is determined at time of delivery, Palmetto Machinery agrees to compensate original purchaser with the necessary parts or modifications needed to have good conform as described in sellers’ invoice. If claim is made due to mis-description or mis- representation of goods, the purchaser will not be entitled to payment for loss of profit or any other monetary damages (special, direct, indirect, or consequential), Outside of necessary parts or repairs needed to have goods conform to reasonable operational condition for being second hand for its age. This warranty provision is valid only if claims are submitted in complete form with detail description by a competent independent 3rd party writing within 30 days of equipment’s arrival at port of delivery as described in seller’s invoice. Claims made are subject to the terms of the invoice contract. Any unresolved disputes will be mitigated thru the American Arbitration Association. This warranty is non transferable and is only valid for the original purchaser. The warranty does not supersedes or void any terms of the sale per Palmetto Machinery’s invoice. |
